investigate imports made through the courier regime

The General Directorate of Customs detected tax inconsistencies around 100 people which, in the second half of 2022, recorded 5,619 imports in it simplified regimen of international deliveriesalso know as courierfor a value of about US$8 million.

In turn, the body that directs William Michel discovered links between people who imported products of the same category: specifically, 931 shipments that entered the country IT merchandisevalued at US$1,706,600. There are several cases in which different members of the same family made imports via the courier regime, many of these being monotributists or presenting a tax situation that deserves to be examined.

This distortion of the regime in question would enable Customs to file complaints in terms of Article 954 of the Customs Code. It is presumed that the objective of the observed maneuvers would have been mask the true situation of taxpayers before the tax authorities and, therefore, the progress of the investigations could imply another course of action.

In this regard, the general director of Customs, Guillermo Michel, stated: “The regime of courier this designed to facilitate the importation of certain products for example, spare parts for small and medium-sized companies. We are going to support the use of the regime to give predictability to the national industry, but exercising firm controls on the abusive use and denaturation of the same”.

For his part, he federal administrator, Carlos Castagnetostated: “There are no doubts: we will investigate the tax inconsistencies detected. Customs, the General Tax Directorate and the General Directorate of Social Security Resources are going to work in a coordinated manner for this”.

How were the different cases discovered?

One of the cases was discovered when specialized agents of the General Directorate of Customs-AFIP found that a monotributista category “B” (annual gross income limit: $1,485,976.96) imported merchandise valued at US$47,084.08more than $9 million.

In addition, his father -which is not registered with the treasury- carried out imports for u$s 37,118.09. The combined value of the operations carried out by both amounts to $16,503,625which supposes, in an absurd way, a deficit of more than $15 million in monotributista activity. In this framework, the AFIP will keep an eye on it to determine its real volume.

Another case observed is that of a family of five: made, via courier, 593 imports of computer products by $1,257,231.

In turn, of the total 100 natural persons it was detected that 7 are not registered with the treasury. The amount imported by them, in 398 shipments, amounts to $202,874.23. Then, 5 that are registered as monotributistas imported goods valued at US$175,900.58 in 534 shipments.

Thus, the people investigated would have appealed to the system of courier for evade the control of the Import System of the Argentine Republic (SIRA) and avoid controls by third-party agencies involved in imports under the general regime.
