The AFIP limited the CUIT of companies formed as Simplified Stock Companies

There are 8,884 companies where the agency detected irregularities related to their tax behavior. In 2020 official legislators presented a bill to suspend the registration of the SAS.

The Federal Administration of Public Revenues (AFIP) limited the CUIT of 8,884 companies formed as Simplified Stock Companies (SAS), upon detecting irregularities related to their tax behavior, the agency reported.

This measure affects 16.5% of the total universe of this type of company, which is currently 53,745 companies, AFIP specified in a statement.

“Among the inconsistencies detected, it was observed that 5,093 companies have not submitted determinative affidavits since January 2022, while another 994 that did submit their Value Added Tax (VAT) and Earnings submissions do not record transactions related to purchases, sales , income or expenses, nor did they report workers on their payrolls,” detailed the AFIP in a statement.

The rest of the affected companies -2,797 companies- do not register tax registration, said the agency.

In March 2020, senators from the Frente de Todos presented a bill to suspend the registration of the SAS for 180 days.

Among its foundations, the legislators argue that, under this figure, an irregular legal vehicle with zero state control is brought into corporate law.

The senators also mention “there are true entrepreneurs for whom this type of company can facilitate their business activity but with the necessary state controls.”
