Through the ENRE Resolutions No. 852 and 853/2023, the Controller Walter Martello determined that the distribution company Edenor SA must compensate 3,900 users who complained to the IN RE by excessive consumption and errors in billing of the serviceand 49 users who complained about problems in installations, networks, connections and meters.

For these reasons, the Entity determined that the distribution company must credit the sum of $44,654 in the invoice of each user, which represents an amount total in compensation of $176,338,646

In the Resolutions it was established that EDENOR did not adequately resolve the claims of the users, and also failed to comply with the obligation to process and respond duly to them within the period of fifteen administrative business daysas established by the Supply Regulations.

Compensation to users: how they will collect the $44,654

From the moment of notification, the Distributor has a period of 10 administrative business days to credit the $44,654 on the next bill of each affected user. If the amount exceeds the total amount of the settlement, the balance must be credited in subsequent receipts. In addition, EDENOR must take care of normalizing the facilities still pending regularization, refund the amounts charged in excess and cancel all interest and surcharges applied for payments on account made.

Regarding this new decision, the ENRE Comptroller, Walter Martellohighlighted: “These resolutions demonstrate how important it is to complain to the ENRE every time companies do not provide an adequate and timely response.” And he added that “the complaint of each user is the main tool to continue applying these sanctions, which in the last year totaled more than $11,000 million between compensations to users and fines for companies.”
