AFIP applies a new system to control payments abroad

Its about Comprehensive Monitoring System for Foreign Payments for Services (SIMPES) which, according to the organization, will allow an evaluation of the economic and financial capacity of the companies that carry out this type of operation.

The SIMPES will be applicable to human persons, undivided estates and legal persons – whatever form they adopt – who must make payments abroad on their own account or for third parties or act as originators of payment to cancel their own or third party obligations.

Through General Resolution 5135/2022, published this Friday in the Official Gazette, the AFIP clarified that the new mechanism is similar to the one already used to import goods.

Thus, the tool extends the evaluation carried out through the Financial Economic Capacity (CEF) system to payments abroad for services.

This system makes it possible to identify firms that cannot prove the origin of the income destined to make the payment abroad of the contracted services.

According to the provisions, the payments for services achieved are: financial, postal and messaging, telecommunications and information technology, legal, accounting and managerial services, advertising, research and development and insurance premiums, among others.

The excepted payments are freight services, passenger transport, health services by travel assistance companies and other health services; travel services and other card payments, such as digital platforms made by human beings.

The new General Resolution came into effect this Friday, but the AFIP clarified that it will even apply to service contracts signed prior to this date, for which there are monetary considerations pending cancellation.

The collecting body justified the application of this new system by stating that “the availability of prompt strategic information enables a greater articulation between the different areas of the State, thus enhancing the results of a comprehensive audit and optimizing fiscal controls and financial flows” .

For this reason, he stressed that through SIMPES “compliance with fiscal duties and the financial economic capacity of the subject who intends to make a payment abroad for the services they provided will be analyzed.”
