It is not unusual in some industries that employees receive additional money for successful degrees. But does the commission have to be paid out in conventional money?
Under certain conditions, workers can receive commissions in the form of cryptocurrency. This emerges from a judgment (10 AZR 80/24) of the Federal Labor Court in Erfurt. According to the court spokeswoman, such an agreement is not necessarily permitted in every employment relationship.
In principle, agreeing as a non -cash reference is only possible if this is in the interests of the employee when considering objective. In addition, a certain unfamiliar amount of the work fee must be paid out in money.
The background to the decision is a dispute between a company that also deals with cryptocurrency and a former employee. This had sued that the outstanding commission claims should be transferred to ether as stated in the employment contract. The company, on the other hand, was convinced that they had already met the claims through a payment of money and argued that it was inadmissible to pay wages in the form of cryptocurrency.
The Federal Labor Court now generally agreed with the judgment. However, the exact amount of the claim must be negotiated and decided by the responsible state labor court in Baden-Württemberg as a lower court.
