Judge Daniel Schmitzberger gave diversion and acquittals for the “customers” who were also accused.

The 22- and 24-year-olds had known each other for a long time and came up with the idea of ​​supplementing their need for money with the forgeries. The second accused, who had previously been convicted, procured the “customers” through his circle of acquaintances and word of mouth, collecting between 100 and a maximum of 300 euros, while his younger friend made the entries in the vaccination register. The money was shared brotherly, or the 22-year-old relied on the honesty of the older man.

In contrast to his accomplice, the 22-year-old did not confess until the trial, but now ruefully admitted everything and asked for a light sentence. Its nine months, which are conditionally postponed to three years, are just as valid as the twelve months, eight of which are postponed to three years. In addition to the four months to be served, there are two more whose probation has been revoked. For an even longer and equally open criminal record, the probationary period was extended to five years.

Schmitzberger assessed the confessions and the previously orderly lifestyle of the first accused as mitigating. On the other hand, the numerous cases and the rapid recidivism of the second accused made things more difficult.

The majority of those who had bought the fake vaccination certificates had already confessed in advance and gotten away with a diversion. Seven others also decided to go this route today and have to do between 30 and 40 hours of community service and pay up to 200 euros.

On the other hand, a young man was acquitted whose brother had bought him the vaccination certificate at the same time and only told him about it afterwards. In case of doubt, there was an acquittal for an entire family who could not explain why they had received vaccination certificates without vaccination. Here it was not enough for the judge that the prosecutor could not think of any other explanation than bribery of the two main accused.
