Guatemalan Justice suspends the presidential candidacy of the leader in the polls

The Justice of Guatemala provisionally suspended in the last hours the presidential candidacy of businessman and right-wing candidate Carlos Pineda, who leads the polls ahead of the June 25 elections.

The news comes a week after the Organization of American States (OAS) expressed its concern about the exclusion of applicants, following the refusal of the electoral court to register the indigenous Thelma Cabrera (left) and Roberto Arzú, son of the late former president Álvaro Arzú (1996-2000), who were projected as strong candidates for the presidency.

Pineda’s participation was “on hold” after the three magistrates of the Sixth Chamber of the Administrative Litigation Court accepted a challenge presented by leaders of the Cambio party, a political group to which Pineda had belonged.

According to the complaint, Prosperidad Ciudadana, Pineda’s current party, committed a series of “illegalities” during the celebration of a candidate proclamation assembly in November 2022, the AFP news agency reported.

The judicial resolution establishes “the nullity of the assembly” and therefore the applications announced in that event are suspended.

Now, the participation of the right-wing businessman, popular on social networks like TikTok, will depend on the Constitutional Court (CC), the highest judicial instance in the country.

“The sixth chamber and its three magistrates granted the provisional amparo (…) temporarily suspending my participation in the presidential candidacy,” Pineda said in a video posted on Twitter.

He announced that they will appeal the ruling before the CC and denounced an alleged “fraud” to leave him out of contention.

According to a survey released at the beginning of May by Prensa Libre, one of the country’s main newspapers, Pineda leads the intention to vote with 23.1%, followed by former Social Democratic first lady Sandra Torres with 19.5%.

They are followed with 10.1% by former UN official Edmond Mulet (center) and with 9.2% the conservative Zury Ríos, daughter of the late dictator Efraín Ríos Montt (1982-1983), prosecuted for the genocide of indigenous people during the war civilian (1960-1996).

Guatemala will hold elections on June 25 to elect the successor to right-wing president Alejandro Giammattei, 160 members of Congress, 20 members of the Central American Parliament and 340 mayors for a four-year term.
