After the case of the Belgian company was reopened three months ago Katoen Natieat the request of the Broad Front, the prosecutor’s office resolved to unarchive the case for alleged irregularities in the signing of the agreement with the government with the company.

The head of the headquarters Economic and Complex CrimesSilvia Porteiro, resolved the dismissal of the case between the government and the Belgian company, Katoen Natie, which has the contract for the Cuenca del Plata Terminal (TCP) at the center of the issue, according to the weekly Search.

The case had been opened three months ago at the request of the Frente Amplista senators Charles Carrera, Mario Bergara and Enrique Rubio who had denounced irregularities in the signing of the agreement with the government where the concession contract for the containers of the Port of Montevideo was extended until the year 2081.

Why was the case filed?

The then prosecutor for Economic and Complex Crimes, Gilberto Rodriguez, had decided to archive the file in November of last year. Among the reasons why he decided to close the case, prosecutor Rodríguez revealed in December that he considered that there was no crime because there was no “arbitrary abuse of power” with a “predetermined intention to cause harm (to the administration or third parties ) or generate a benefit to individuals”.

On the opposition side, they pointed out that the lawyer focused too much on a particular crime, when there were multiple charges in the accusation. In addition, they remarked that, at least, the current president of the National Administration of Ports (ANP), Juan Curbeloshould be charged with the elements that exist, since it did not go through the board of the body that conducts the resolution that endorsed the agreement for the extension of the concession.

In the original complaint they were also accused Luis Alberto Heberwho at the time the agreement was signed was Minister of Transport and Public Works; Rodrigo Ferres, Deputy Secretary of the Presidency; and Juan Jose OlaizolaUndersecretary of Transportation and Public Works.
