The head of the Bolshoi Theater mimic ensemble, Yekaterina Mironova, who is accused of violating the job description, which led to the death of actor Yevgeny Kulesh, may be prosecuted. Lawyer Vasily Vorobyov spoke about this on Sunday, January 2, in an interview with Izvestia.
“This is not necessarily a real imprisonment, but it is definitely criminal responsibility. That is, you need to understand that if they still find signs of corpus delicti in her actions, then she will be brought to criminal responsibility, ” – he explained.
The lawyer noted that this can be a conditional imprisonment, which can be replaced by a court fine.
According to him, Mironova can be acquitted, because the theater does not have a mandatory medical examination.
“That is, formally, before releasing an actor on the stage, there must be a check that he is intoxicated. On the other hand, we do not have a mandatory medical examination. Secondly, there is no mandatory alcohol test. Therefore, it is unlikely that she will be attracted here. But if they do, there will be a criminal offense, ”Vorobyov emphasized.
In addition, the expert noted, the leadership of the Bolshoi Theater will also be held accountable, since the tragedy is regarded as an industrial accident.
“A certain commission should be appointed here and this accident should be investigated. But by and large, yes, this person’s family is entitled to compensation for death. The claims to the theater are absolutely legal, ”the specialist concluded.
On January 2, the lawyer of the injured party, Andrei Aleshkin, told Izvestia that the commission to investigate the circumstances of the tragedy had established that gross negligence was seen in Kulesh’s actions, but his fault was 10%.
In turn, the Bolshoi Theater concluded that the head of the mimic ensemble, Yekaterina Mironova, violated the requirements of the job description, expressed in insufficient control over the artist’s observance of labor and production discipline.
The artist of the mimic ensemble Yevgeny Kulesh died on October 9 on stage during a change of scenery in the opera “Sadko”. The law enforcement agencies reported that the deceased did not hear because of the noise that it was time for him to run away from the scenery, which was rapidly descending onto the stage.
