SPD politicians: Check AfD prohibition procedures seriously

Should there be an application for ban on the AfD? The SPD leadership wants to drive the debate forward – and makes an application to vote at the party congress.
The SPD urges a quick decision on a ban on a ban against the AfD. At the end of the federal party conference in Berlin, an application is to be decided late in the morning, which is committed to preparing for appropriate preparations. “Now is the time that the constitutional organs’ applicant will create the prerequisites in order to be able to apply for an application to determine the unconstitutionality of the AfD,” it says.
“In this application, we say very clearly that we assume that the AfD is the greatest danger to our democracy and is actually working to abolish this democracy,” said the Bundestag MP Carmen Wegge of the German Press Agency. All steps would now have to be initiated in order to achieve a review of the AfD before the Federal Constitutional Court.
Working group is supposed to collect material for prohibition procedures
The demand for the initiation of a prohibition procedure against the AfD had become louder after the Federal Office for the Protection of the Constitution had classified the party as secured right -wing extremist. However, due to the legal approach of the AfD, the classification is initially on ice. At the request of the Federal Government, Bundestag or Federal Council, the Federal Constitutional Court would have to decide on a party ban.
In the application of the SPD party executive, a federal-state working group is now required, which should examine the chances of success of a prohibition procedure and collect material for it. “If this examination shows that we can provide evidence in court – and we assume that we can proof – then it is no longer a political decision for us to make this prohibition application, but a democratic obligation,” said Weg.
The Greens had also spoken out for a working group recently, Chancellor Friedrich Merz sees the calls “very skeptical” according to a ban procedure. Just a few days ago, in a different case, the ban on the right -wing extremist magazine “Compact” had failed at the Federal Administrative Court.
The new SPD leader Bärbel Bas, on the other hand, already emphasized on Friday at the party congress in Berlin: “We should now be very quick to clarify whether there is enough material to have the AfD’s unconstitutionality checked by the Federal Constitutional Court.” If there is evidence, “then as a SPD we are in the democratic obligation to make all efforts so that a prohibition application can take place”.
