The State Duma proposes to exempt local authorities from administrative fines that they are issued for failure to comply with fire and industrial safety requirements, as well as construction rules, and ensure the sanitary and epidemiological well-being of the population. As Izvestia found out, Yaroslav Nilov, head of the committee on labor, social policy and veterans’ affairs, and a number of other deputies intend to submit such a bill to parliament.
“In December 2019, amendments to the Code of Administrative Offenses of the Russian Federation were adopted in Russia, which toughened liability for non-execution of court decisions by debtors. For legal entities, punishment was introduced for this: fines in the amount of 1 to 3 million rubles, or suspension of activities for up to 90 days. According to the legislation, local governments are subject to registration as legal entities. Therefore, this measure of punishment is also applied to them, as to legal entities, which is unacceptable, ”Yaroslav Nilov explained to Izvestia.
According to him, today the executive orders are not executed by municipalities only because of the lack of funds in the budgets of rural and urban settlements.
“If the budget of a rural settlement, which, for example, is 10 million rubles a year, does not have funds to fulfill the requirement for a writ of execution, but it is necessary to build treatment facilities that can cost 30 million rubles, the millionth fine will not induce the administration to execute the court decision . On the contrary, it will drive you into even greater debts, and if the administration is suspended, the result will be deplorable,” the parliamentarian emphasized.
In 2019, the Cabinet of Ministers proposed to exclude administrative responsibility for state authorities, local governments, state and municipal bodies, management bodies of state non-budgetary funds with the status of a legal entity, and state institutions as legal entities. This was discussed in the concept of the new Code of Administrative Offenses.
