The Government exempted cars manufactured in the US from the pedestrian protection test

Through a joint resolution published this Tuesday in the Official Gazette, the National Road Safety Agency and the Ministry of Industry and Commerce established that vehicles produced under North American FMVSS standards may be approved in Argentina without complying, for now, with that safety requirement.

The National Road Safety Agency (ANSV) and the Ministry of Industry and Commerce of the Ministry of Economy made official this Tuesday the Joint Resolution 3/2025through which exempt from compliance with the pedestrian protection test to the new vehicle models of categories M1 and N1 manufactured in the USA under the Federal Motor Vehicle Safety Standards (FMVSS).

The measure – which bears the signatures of the executive director of the ANSV, Francisco Díaz Vegaand of Secretary of Production Coordination, Pablo Agustín Lavigne– establishes that the dispensation will govern up to one year after the requirement is mandatory in the country of origin.

According to the foundations of the norm, the decision responds to the request of the Association of Automotive Factories (ADEFA)who argued that the trial still not required by US regulations and therefore It is not part of the certifications issued for approval of models in that market.

The text also clarifies that in Argentina there is currently no technical capacity to carry out said test and that the new provision is dictated within the framework of reforms that seek to simplify regulations and reduce state interference in the economy.

The recent resolution published by the Government maintains that “This exception not only aligns our regulations with global realities, but also stimulates the free market and reduces state interference”as detailed in its recitals. The text makes direct reference to Decree 196/2025one of the key measures promoted by Luis Caputo from the Ministry of Economy to simplify administrative processes and promote competition in the industrial sector.

From the private sphere, they explained that “United States legislation is in the process of reform, but until it is mandatory there, standardizing it here would be technical and economic nonsense”referring to the costs and times that the trials would involve. In this sense, the resolution recognizes that Argentina does not have authorized laboratories to perform the required tests, which would require send vehicles abroadsignificantly increasing costs.

The origin of this flexibility dates back to a agreement signed in 2017 among automotive companies, the then Ministry of Transportation and the National Road Safety Agency (ANSV)which established the obligatory nature of the test from the January 1, 2025following rules European (ECE) either global (UN GTR-9).

Finally, the Government of Javier Mileithrough the Decree 196 and the Resolution 271 of Julychose to accept reports from internal laboratories endorsed by the NHTSA “blue ribbon letter”prioritizing the regulatory efficiency and agility. The measure, signed by Diaz Vega and Pablo Lavigne, comes into effect immediately and will be communicated to Official Registry.
