The measure was formalized through provision 73/2022 of the National Directorate of the National Registries of Automotive Property and Pledged Credits (RNPA). published today in the Official Gazette.
The rule implies an adjustment of 0.73% in relation to the amount established in provision 14 of January 24 of this year and involves “operations related to motor vehicles with 2, 3 or 4 wheels of 300 cc. superior; coupé; microcoupé; sedan with 2, 3, 4 or 5 doors; rural with 2, 3, 4 or 5 doors; convertible; convertible; limousine; all-terrain; family and pick-up”, detailed the standard.
Likewise, the clause that indicates that the amount will be automatically adjusted in January and July of each year based on the percentage of increase in the Price Index of the Automotive Sector accumulated in the last six months, from the next business day of the date of publication on the website of the Association of Automotive Dealers of the Argentine Republic (Acara).
Based on the latest price list of the entity, certain models of Chevrolet Equinox, Citroen Jumper, Fiat Ducato and Toro, Ford Bronco, F-150, Kuga and Ranger, Jeep Commander, Nissan Frontier, Peugeot 3008 would be covered by the measure. , Renault Alaskan and Kangoo ZE, Toyota Corolla Cross and Hilux, and Volkswagen Amarok.
The profile of the user that those in charge of the registries must prepare “will be based on the information and documentation related to the economic, patrimonial, financial and tax situation, that the user would have provided or that the Registrar himself could have obtained”, indicated in the rule that updates the amounts of provision 293/2012 and its amendments.
One of the main regulatory antecedents of the provision is resolution 127/2012 of the FIU, which established the procedures and deadlines that must be taken into account “for the purposes of making the Suspicious Transaction Report (STR), the obligation to designate a Compliance Officer, the criteria to determine if certain operations are suspicious, and the opportunities and limits of compliance with the obligation to report them”.
In that resolution, it was also established that the National Directorate of the National Registries of Automobile Property and Pledged Credits “must formally adopt a written policy in compliance with the laws, regulations and norms to prevent and impede money laundering and the financing of terrorism, mandatory for all Sectional Registries under their jurisdiction”.
