From July 6, 2022, Regulation (EU) 2019/2144 will come into force, according to which new vehicle types must be equipped with the intelligent speed assistance system (ISA). We bring light into the darkness of the legal jungle.
What is the regulation about? The aim of Regulation (EU) 2019/2144 is to significantly reduce the number of fatalities and injuries caused by accidents involving excessive speeds. According to the Federal Statistical Office, in 2018 almost half of the fatal accidents (61 out of 123 fatalities) on roads with speed limits were caused by “inadequate speed”. That is why the intelligent speed assistance system (ISA) is being introduced. According to various studies, these accidents can be reduced by ten to 20 percent if an intelligent speed assistance system (ISA) is installed in the vehicle.
What is Intelligent Speed Assistance (ISA)? The Intelligent Speed Assistance (ISA) is basically nothing more than a system that combines assistance systems such as adaptive cruise control, traffic sign recognition with the navigation system, i.e. a technology that many modern cars already have on board. These are often cameras that “work together” with the GPS data of the navigation maps. With the help of this sensor fusion, the car should recognize speed limits, inform the driver and, if necessary, reduce the speed.
How does the ISA work? Basically, the ISA acts like an adaptive cruise control already does today. If the system recognizes a speed limit from a sign or other traffic sign, the driver is informed acoustically (e.g. by a flashing symbol in the instrument cluster) or haptically (the counter-pressure of the accelerator pedal increases). However, the EU Commission also allows a reduction in engine power or gentle braking interventions. But these are also functions that every driver who is on the road with modern assistance systems is familiar with.
What happens if I have to accelerate during a speed limit – for example when overtaking? The ISA is an assistant, nothing more and nothing less. This means that the driver is always in full control of his vehicle and can therefore override the system with a press of the accelerator pedal. Just as is the case today. Anything else would also be dangerous. In addition, the driver can easily switch off the ISA. However, the system must be automatically reactivated when the vehicle is started.
What happens to the data? A black box is on board. But anyone who is afraid of the transparent driver can relax. There will be no speeding tickets. Rather, the only seconds before and after an accident should be saved and anonymously in a closed system. For example, the data is passed on to accident research and not to insurance companies.
When is the ISA mandatory? The EU Commission has presented a very clear timetable for the introduction of the speed brake. From July 6, 2022, all new vehicle types must be equipped with the ISA. All cars, trucks, vans and buses are affected. From July 7th, 2024, the system will be mandatory in all new cars.
How much does it all cost? The system is free for the first seven years. After that, it is up to the manufacturer whether to charge a fee for the ISA system. However, this case should only rarely occur because the car manufacturers, in their efforts to enable autonomous driving, already have the necessary technology on board at this point and the ISA is then a by-product.
