The National Government unified the tasks of ENRE and Enargas and created the National Regulatory Entity of Gas and Electricity, a megaorganism that will seek the “reorganization” of the energy sector.

He took a significant step towards the reorganization of the energy sector with the creation of the National Regulatory Entity of Gas and Electricity, as provided by Decree 452/2025 published in the Official Gazette.

This new autarkic body, which will operate under the orbit of the Ministry of Energy of the Ministry of Economy, seeks to unify the functions of the gas regulatory entities (Enargas) and the electricity (ENRE), in which it seeks to simplify the administrative of the country.

The measure responds to the guidelines established in Law 27,742, known as the Base Law, which promotes efficiency and adaptation to international standards in the supervision of both sectors. With a period of 180 days for its implementation, the new entity promises to centralize regulation and improve coordination in a key area for economic and social development.

Through Decree 450/2025, which approves adjustments to laws 15,336 (Electric Power Regime) and 24,065 (Electric Regulatory Framework), the National Government also defined the legal basis for a structural reform of the electrical sector, which they claim, “will benefit the user and will have the private sector as a key actor.”

The free choice of the supplier by the end users is ratified, guaranteeing that consumers can decide who to hire their energy, without regulatory obstacles or operational obstacles.

Regulatory mechanisms are introduced for the user to know what pays. Your invoice may not include local taxes or charges outside the goods and services actually invoiced.

Multiple alternatives are established for the development of electric transport infrastructure, seeking private investment, enabling free initiative at their own risk.

In addition, and in a coordinated manner with the process of normalization of the wholesale electricity market (MEM) carried out by the Ministry of Energy of the Ministry of Economy of the Nation, the decree sets a transition period of 24 months, during which all complementary regulations must be adapted and guarantee a gradual, orderly and predictable implementation of this transformation.

Thus, the National Government returns to the electricity sector its true essence: an industry based on private investment, economic-financial self-sufficiency, market signals and freedom of choice.
