In the Russian Federation may begin to punish for the negligent disclosure of personal data

The Code of Administrative Offenses (CAO) is planned to be supplemented with provisions that will determine responsibility for non-compliance with the confidentiality of personal data of citizens, a federal official and a source close to one of the relevant departments told Izvestia.

Non-observance of confidentiality may look like this: a loan agreement of a bank client can be sent to a third party without any notification, the Center for Legal Assistance to Citizens in the Digital Environment explained to Izvestia.

Another situation that this organization is talking about is the duplication of personal accounts of bank customers: due to this incident, which is associated with a negligent attitude towards the identification of citizens by a credit institution, strangers can learn a lot of interesting things about each other.

The law “On Personal Data” prescribes to observe the confidentiality of a citizen’s personal information during its processing and not to disclose it to third parties. But it is not easy to punish violators now, since the Code of Administrative Offenses does not provide for fines for such violations, Izvestia’s interlocutors note.

At what stage is this legislative initiative, they did not comment.

Every year, Roskomnadzor records several hundred cases of non-compliance with confidentiality requirements by operators, their number is growing, the department notes.

In 2019, there were 361 of them, in 2020 – 427, in 2021 – 475. The inclusion in the Code of Administrative Offenses of new elements of administrative offenses, which will fully ensure the implementation of the principle of inevitability of punishment for non-compliance with the requirements of the law regarding the confidentiality of personal data, will improve security personal data of citizens, consider in Roskomnadzor.
