The Justice authorized the first embargo on virtual wallets requested by the AFIP

The development of electronic means of payment and their widespread use led the monetary authority to include digital accounts in the list of assets that can be seized to collect debts since February. Until now, the entity could only request authorization from the courts to execute embargoes on bank accounts, real estate and credits, among others.

Based on the request made by the AFIP, the judge ordered the embargo on the virtual wallets of the evading taxpayer until the amount of the accumulated debt was covered. “Attention to the state of the proceedings, without the defendant to date having regularized and/or canceled the debt executed here, with the aggravating circumstance of having the negative result of the general seizure of bank funds and securities, is that I request the seizure of the digital assets of the defendant,” said the brief presented by the AFIP lawyers.

“Consider evidence of a general bank embargo with a negative result. Attentive to the status of the proceedings, for the sum claimed with more than 15% that is provisionally budgeted to respond to interest and costs, I decree an embargo on the sums that the executed party has to receive from the individualized signatures in the writing to the office, ”argued the ruling that operationalized the embargo on digital assets.

The AFIP reported at the beginning of February that it had identified a universe of 9,800 delinquent taxpayers for whom it will request the court to place embargoes on virtual wallets. The agency intends to advance in the collection of $24,000 million in taxes owed by these taxpayers.

The executions of fiscal debts with the AFIP, the step after the seizure block, were suspended for 19 months as part of the tools implemented to cushion the economic effects of the COVID-19 pandemic. Throughout this period, the agency made available tools to regularize the accumulated liabilities.

In line with the economic recovery process that the country is experiencing and with the aim of protecting the fiscal interest, in February the entity resumed the fiscal executions of delinquent taxpayers, especially taxpayers with larger amounts of debt.

In order to determine which accounts to apply for embargoes, the AFIP relies on the information regime that, as happens with financial entities, obliges companies in the sector to report information referring to their clients’ accounts.
