Faced with this lack of agreement, the entity led by Roberto Feletti will develop an initiative to promote the tax on empty housing, something that has the support of the National Federation of Tenants.

Secretary Feletti raised the control of compliance with the current law through Consumer Defense.

The latter was also put into the debate since Tenants stressed the need to establish a channel for complaints in that body.

Regarding the empty housing tax and the complaints channel, the parties will meet again in the coming days to discuss them.

“Rental is an essential issue, that is why we set up this table. We have the obligation to apply regulatory policies and consensus policies. It is the task of the State to bring the laws closer to the citizenry. From the Secretariat we seek to protect the tenant within the framework of current law and increase the supply of rental housing”, said the Domestic Trade official.

Rental Law: what are the differences between what tenants and real estate companies ask for?

The National Federation of Tenants proposes the regulation of the initial rental price, which is set at 2% of the tax value of the home, “this being the only price that the State regulates and updates every year and for which the owners pay their taxes“.

The application of a 5% tax on the fiscal value of real estate in disuse for more than two months for all those who have more than three properties, is another of the central points of the proposals of the Federation chaired by Gervasio Muñoz.

“The empty housing tax is a measure that is taken in almost all the big cities of the world. Its function is to limit speculation, and increase supply to lower the pressure on prices,” he remarked.

They will also address the need to establish a channel for complaints before the Consumer Defense / Secretary of Commerce for non-compliance with the legislation applicable to rental relationships; that an official measurement of rental prices be carried out; and greater control of the AFIP over real estate companies.

From Inquilinos, they pointed out the need to control breaches related to: electronic payment, billing, indexation in violation of current legislation, illegal contract term, dollarized price, transfer of taxes to the tenant, arbitrary expenses and misleading real estate advertising or with illegal demands.

They also raise the need for an official price measurement of housing rentals through the Ministry of Commerce. “Today there is no official measurement of rental prices. The State does not know how much rent is paid,” he clarified.

For his part, the president of the Argentine Real Estate Chamber, Alejandro Bennazar, said that the entity will insist on the need to “modify the law, make a new one or roll it back, and attend to the modification of the money laundering law, that the unit be incorporated used, not just the new one, in addition to a battery of proposals related to tax issues”.

He argued that “the offer” of rentals must be increased, and for this he considered that the rental contract must be “retroverted to two years, have alternative rates to be chosen by the parties and an update every six months.”

Regarding the tax on empty housing, he said that “we do not see it feasible”, and pointed out that “the table is going to generate a consensus; all the creation of alternatives that the only thing they achieve is to scare away income investment, we believe that we have to look for alternatives of benefit and not impact,” he said.

In recent weeks, the Chamber has been holding meetings with national officials and legislators with the aim of promoting a modification of the Rental Law that will be in force for two years next July.

“We note great concern from all sectors and especially from the State to see how we reverse the situation; it will not be short-lived to have results and what is proposed we do not know if it will activate the market or not,” concluded Bennazar.
