Defeat for the federal government after the failure of the car toll: According to a decision by the arbitration court, the planned operating companies are entitled to compensation from the Federal Republic. This was announced by the companies CTS Eventim and Kapsch TrafficCom in a statement to the stock exchange.
They referred to a submitted interim award. In the second phase of the arbitration that follows, the amount of the claim will be decided.
The car toll – a CSU prestige project – was stopped in June 2019 by the European Court of Justice as illegal. The intended operators are demanding 560 million euros in damages after the federal government terminated the contracts after the verdict. The federal government had rejected the claims, and arbitration proceedings followed.
The arbitral tribunal confirmed that the claims asserted by AutoTicket GmbH, a joint venture of Kapsch TrafficCom and CTS Eventim, exist on the merits, the companies announced. Accordingly, Germany was not allowed to withdraw from the contract unilaterally and without compensation.
