the AFIP reinforced controls to avoid fraudulent maneuvers

General Resolution 5190/2022 specifies that the limit established for the same recipient, set at US$3,000, 50 kilos and three equal units of the same kind, will apply for each flight.

The rule seeks to prevent operators from dividing their orders on the same flight so that each shipment does not exceed US$3,000 and, in this way, exceed the maximum amount established.

The norm seeks to avoid distorting behaviors identified by the DGA with respect to certain importers that violated the spirit of the regime, identified maneuvers that distort the purpose for which this tool was created.

The AFIP dependency filed the corresponding complaints in those cases where an action was observed aimed at preventing or hindering the adequate exercise of the powers of the customs service in the control of the international transit of merchandise.

Currently, the regime for small personal shipments, without commercial purpose, establishes up to five of these orders per year, while for those with a commercial purpose, there is no annual maximum.

The amendments aim to “maintain good foreign trade practices and protect foreign trade operators who comply with the rules.”

The use of courier services has been growing in recent times due to the increase in electronic commerce, recalled the DGA, which considered that it is an agile tool that simplifies processes and in which Customs optimizes controls.
