The initiative does not contemplate a reduction of the tax base in the event that the presumed “Unexpected Income” is destined for productive investments.
The bill promoted by Martín Guzmán from the Ministry of Economy will enter the National Congress in the next few hours by the Chamber of Deputies, as established by the constitutional norms referring to tax proposals.
In a practical example: If a company earned $1,000 million in 2021 (already adjusted for inflation) and in 2022 its profitability was $1,200 million (also real), it will pay 35% on the $1,200 million and an additional 15% on $200 million (the difference between $1,200 and $1,000).
According to Economy calculations, in 2021 some 600 companies earned more than $1,000 million deducting operating expenses and, if the same situation is maintained, in 2022, between 350 and 360 companies would also meet the rest of the parameters set for the payment of the tribute.
Although the initiative is launched as “Unexpected Income” due to the effects of the war, the tax will be “transversal” and will impact all companies that meet the established parameters, regardless of whether or not their activity is linked to the conflict. warlike
The conditions
Companies with Net Taxable Income or Accounting Income greater than $1,000 million and whose Net Taxable Income has grown in real terms and that meet one of these conditions:
Profit margin (accounting profit on your income) in 2022 greater than 10%
Increase in profit margin in 2022 compared to 2021 of at least 20%
Due to the different closing dates of balances, it is established that the tax is in force from one month after the sanction of the law and for one year.
From the Ministry of Economy they emphasize that it is a tax that will be charged only once.
