Last night, the Federal Administrative Litigation Court No. 12 upheld an appeal filed by the Professional Council of Economic Sciences of the Federal Capital (CPCECABA).

The ruling, signed by the federal judge Macarena Marra Gimenezorders to extend the maturities and the payment of both taxes “until after sixty (60) days have elapsed since the web systems necessary to carry out said work were made available, that is, from July 12 onwards”.

The Cpcecaba argued that the necessary applications for the liquidation of taxes “became effective in the middle of the month of May, with errors that deserved corrections and that constituted an important contribution to the confusion and complexity in carrying out the task”.

Meanwhile, in a statement, the AFIP today described the judicial measure as “regrettable” and stressed that “it only reaches professionals enrolled in the Cpcecaba”.

“The judicial decision only reaches their own sworn statements and when said professionals intervene as representatives of clients who have formally delegated access to AFIP services to them,” stressed the tax body led by Mercedes Marcó del Pont.

In the same way, he recalled that those Cpcecaba professionals who consider it “can self-exclude and make their presentations.”

“It is unfortunate that a judge of first instance dictates, contrary to the procedures provided for in the law, an interim measure that seeks to harm the State’s ability to collect taxes,” questioned the AFIP, and indicated that “it is a serious fact.” because “it affects co-participation and, therefore, the financing of the provinces and municipalities throughout the country.”

After the ruling, the legal areas of the AFIP will present today the report required by the Justice.

According to the organization, “more than 30% of the people reached (by the taxes) have already fulfilled their obligations, even before the due dates begin.” In the statement, the AFIP anticipated that “it will verify the correct use of fiscal codes” and recalled that it is “personal and non-transferable.”

Although “there is the possibility of formally delegating a service such as the presentation of an affidavit”, the AFIP emphasized that it is not legal “for another person to enter with a tax code other than their own to carry out procedures”.

The presentations and payments of Earnings and Personal Assets may be fulfilled until the following dates, according to the termination of the Unique Tax Identification Key (CUIT) of the taxpayer: those ending in 0, 1, 2 and 3 will have a date of presentation until the day of today and payment date until June 24; 4, 5 and 6 presentation date until June 24 and payment until June 27; and 7, 8 and 9 presentation until June 27 and payment until June 28.
