The conflict over the expiration of taxes began last week, when the Council obtained a precautionary measure that suspended the maturities, before the Federal Court 12. The AFIP appealed and for 48 hours the judge restored the deadlines. Now the high court has granted the accountants the suspension again.
Domínguez indicated that “the sentence on the merits of the matter, which is the request for the postponement of maturities, may take time.” He argued that professionals can “count on 60 days from the availability of the web applications to prepare the affidavits.”
The conflict also escalated in territoriality. In Salta, the Professional Council of the province also obtained an injunction in the same sense, while 17 councils at the national level adhered to the claim presented in the Federal Capital.
Domínguez considered that, if the AFIP agreed to rethink its position, “all taxpayers in the country would have uniform maturities and the AFIP should not make changes to its systems, implement records and controls to discern who is covered by the suspension and who is not.”
One of the problems with the ruling is that the Justice said that it reaches accountants and their clients who have formally delegated representation before the AFIP, and also those who work as advisors.that is, they did not inform the AFIP about that contractual relationship.
