Electricity suppliers are prohibited from reflecting the adjustment of the Iberian mechanism in invoices for exempt consumption, in accordance with the instruction approved this Friday by the Energy Services Regulatory Authority (ERSE).

“Today, ERSE approved Instruction No. 6/2022 aimed at ensuring that electricity suppliers do not reflect the value of the adjustment associated with the Iberian gas price cap mechanism for electricity generation in exempt consumption bills,” the industry regulator said in a statement.

Consumers who signed contracts for the supply of electricity at fixed prices before April 26 this year cannot be involved in paying for the consequences of this measure, agreed with Brussels.

Thus, ERSE intends to clarify that invoices for exempt consumption cannot include “any reference to the cost of adjusting the market price, to the Iberian mechanism or to Decree-Law No. of equivalent effect”.

Suppliers that violate this decision are subject to a fine of up to 10% of the turnover made in the year prior to the final conviction.

ERSE also guaranteed that it would continue to provide information to explain to market agents the correct application of the Iberian mechanism.

Endesa President Nuno Ribeiro da Silva said on 31 July in an interview with Jornal de Negócios and Antena 1 that there would be an increase of around 40% in July electricity bills and that this increase was justified by the Iberian control mechanism. the price of gas in electricity generation.

Following these statements, the Ministry of Environment and Climate Action released a statement rejecting Nuno Ribeiro da Silva’s statements, calling them “alarmist”.

After the controversy, Endesa issued a statement on August 1 in which it committed to keep the contract prices until December and to fulfill the obligations set out in the Iberian Mechanism.
