Customs denounced a millionaire underinvoicing of exports

“Specialized agents of the agency headed by Guillermo Michel determined that the company’s sales had been made to a Uruguayan firm that belongs to the same economic group as the former and that, with this maneuver, at least $1,270,000 were left abroad. (more than $190 million),” explained Customs in a statement.

The complaint

The firm denounced is El Cerco, which is based in the province of Entre Ríos. According to official reports, the defendant concentrated more than 42% of the exports of this merchandise at the national level between 2020 and 2022.

The expeller is one of the main byproducts obtained from the extraction of soybean oil and is used, above all, for animal feed. It has between 5% and 8% oil and is mainly intended for the livestock industry. Argentina is one of the main international exporters.

“It should be noted, the ruse detected by the customs investigation is serious not only in the current situation of shortage of foreign currency, but also generates unfair competition with the other producers of the merchandise in question, both Argentines and Uruguayans”, they expressed from the Customs .

As a result of the agency’s investigations, the Federal Court of Gualeguaychú, in charge of Hernán Viri, who is in charge of the case, ordered raids at the El Cerco plants, which has its headquarters in the vicinity of Villaguay.

The underinvoicing of exports is an illegal maneuver used by some companies to keep foreign currency in their possession abroad and circumvent State controls. This is just one of the behaviors that Customs monitors, which in recent months has also deepened the monitoring of the overinvoicing of imports, triangulation, the improper use of free zones and precautionary measures obtained by companies in the contentious administrative justice to access imports that the relevant agencies had denied them. In the latter case, the injunctions still pending implementation began to fall this month as a result of the new import system (SIRA) implemented by the AFIP and the Ministry of Commerce.
