Whether in professional or private matters, whether personal or digital: the notary’s office provides legal support to clients in many areas of life. We asked Birgit Mohr from Marchtrenk and Christian Huber from Windischgarsten for an interview.

Why did you choose this legal profession and what is special about it?

Mohr: What is special about the profession of notary is that by law the interests of all those involved must be taken into account. Avoiding disputes through legally secure design and sustainable solutions for all parties are the focus of my work. Advising clients and finding tailor-made, meaningful, sustainable and, last but not least, conflict-avoiding solutions was and is the greatest challenge of our profession for me.

Why should clients use legal services from notaries when there are also online templates?

Huber: Such templates harbor several risks: On the one hand, they often only regulate general issues and do not address the individual circumstances of the respective client. On the other hand, many templates refer to the German legal system, so they may be completely useless in Austria. If in doubt, you should always take advantage of the free initial consultation with the notary you trust.

Why do notaries see themselves as the so-called “legal life companions” of the clients?

Mohr: Notaries advise and look after their clients in almost all situations. The long-standing trust of our clients is the greatest compliment.

What do you think everyone should have regulated?

Mohr: Every citizen should make a will and take precautions in the event that he is no longer able to make decisions as a result of an accident or illness. The legal and economic consequences of inheritance proceedings, in which provisions for death are not made in good time, e.g. in the form of a will, can, in the worst case, threaten the existence of the bereaved, but also for the company.

Which developments in the Austrian notary’s office would you like to see in the future?

Huber: I would wish that notaries would continue to enjoy the trust of the population and companies in the future and grow with the constant challenges, such as ongoing digitization.
