Article 89 of that project, in its third paragraph, provided that “given the public service nature of both the distribution and the transportation of electrical energy, the national State and the provincial jurisdictions must publish, in a period not exceeding ninety (90) days, rate charts that allow distributors to comply with the obligations resulting from the previous paragraph, ”says the decree in its recitals.
Among those commitments was that “The Ministry of Energy will establish a unit of measurement of homogeneous value linked to transactions for consumption that ensures the value of the credit and will implement a debt regularization plan of up to ninety-six (96) monthly installments”.
And although the Government clarifies that “the wording used in said paragraph and finally incorporated into the sanctioned norm has been defined in the ambit of the HONORABLE CONGRESS OF THE NATION”, then it remarked “that said paragraph regulates issues related to the tariff schedules, the which do not conform to the current regulatory frameworks”.
“The elaboration, proposal and execution of the national energy policy is the responsibility of the NATIONAL EXECUTIVE POWER”, he maintains.
Therefore, “by virtue of the foregoing, and since it could be considered as an interference in the provincial sphere, since the regulation in the electric power distribution system is of provincial/municipal competence, exceeding the powers delegated to the Nation, it is necessary to observe the third paragraph of article 89 of the sanctioned bill”.
Nevertheless, he concludes that “This measure does not alter the spirit or unity of the enacted bill.”
