justice confirmed the authorization to seismic exploration

According to estimates by the companies that are involved in the exploration of the basin, Equinor, YPF and Shell, the deposit could generate annual exports of more than US$20,000 million. Up to now, they had invested in the project US$100 million.

At the end of December the organizations presented an extraordinary resource considering that the sentence had potential of definitive effectsand in the document presented by the NGOs it was expressed: “We are facing the eventual provocation of damage to the environment that cannot be repaired subsequent, so that the resolution is comparable to a final sentence”.

Despite this, the Chamber resolved and announced this Wednesday reject resources of environmentalists, and point out that the decision to annul the precautionary measure that stopped the activity during the past year “does not constitute a final judgment since it is precisely a precautionary and not a substantive resolution within the framework of the amparo”.

“There is no doubt that, even after the appealed resolution has been issued, the substantive right that is being discussed and does not cease to be litigious, and the question addressed may be reissued in the event of new grounds,” said the Chamber in its resolution, and expressed that “the means raised by environmental NGOs do not meet the “minimum and basic requirements” to be analyzed by the superior court (Supreme Court of the Nation).

In December the Chamber considered that both the Government national as Equinor met the requirements that had been requested, and partially revoked the measure issued by the judge Santiago Martin. At the same time, they had established a series of “essential conditions“for the execution of oil exploration.

They arranged that members of the “Pampa Azul” team should be included as “permanent observers”in the number of members that the administrative authority deems appropriate, who “must ensure the care of the Right Whale Natural Monument, the guardianship of the Blue Hole, as well as denounce any event that significantly affects the environment to the administrative and judicial authorities, in order to promote the immediate suspension of activities”.

Another of the conditions set, at the time, was that seismic prospecting activities “should not be carried out at a distance of less than fifty 50 kilometers” of the sector comprising the area called “blue hole“.

Third, the exploration “should be suspended immediately upon verification of any event that significantly damages the environment, both by the administrative or judicial authorities and by those responsible for its execution”.

Finally, they had urged the administrative authorities to “promote and permanently maintain a maximum level of control” on the exploration tasks, in order to “comply with the mandates that the law imposes in the matter with respect to the protection of the environment, and to ensure compliance with any of the previously established conditions, and the immediate suspension of project activities in case of non-compliance”.
