Processes: Court dismisses climate action against BMW

The carmaker BMW will not necessarily have to stop building petrol and diesel cars from 2030 onwards. This was decided by a Munich court.

The German Environmental Aid has failed with a climate lawsuit against BMW. The club had asked the Munich carmaker to stop selling petrol and diesel cars from 2030. The group had rejected the claim as unfounded. The decision of the District Court of Munich I on Tuesday is not yet final.

The plaintiffs see their general personal rights violated by the CO2 emissions from car sales. The court did not rule out such interference, but ruled that there was no threat of unlawful infringement at this point in time.

The judges referred to a decision by the Federal Constitutional Court from 2021, which obliges the legislature to protect the climate. In the present case, no special features are evident that could lead to a different assessment. A similar lawsuit brought by environmental aid against Mercedes-Benz was also dismissed by the Stuttgart Regional Court in September.

BMW welcomed the judgment of the district court. “The discussion about how to achieve the climate goals must take place in the political process, through the democratically legitimized parliaments – but not in the courtroom,” said a spokesman.
