A car buyer who reclaimed the purchase price won his case in the Supreme Court. It is the first time that the OGH has dealt with the content of the emissions scandal, as the court announced in a press release on Monday. In the judgment of February 21 (10 Ob 2/23a), the Supreme Court obliged the vehicle dealer to repay the purchase price step by step against return of the vehicle and awarded the dealer a fee for using the vehicle. The proceedings against the vehicle manufacturer were interrupted due to pending proceedings before the European Court of Justice.
