In this way, taxpayers whose main activity is agriculture-livestock and the property in which they develop it is located in an emergency zone and/or agricultural disaster due to drought, and those that are declared and approved until December 31 from 2023, inclusive, they will automatically obtain the benefits.

This was provided by Decree 193/2023, published this Monday in the Official Gazette.

According to the decision, the affected producers will enjoy -among others- the following benefits:

  • Suspension until the next productive cycle after the end of the emergency period and/or agricultural disaster due to drought, of the initiation of tax execution trials and lock of precautionary measures. For the same period, the course of the procedural terms, the prescription and the expiration of the instance will be suspended.
  • Tax foreclosures for the collection of taxes owed started after February 1, 2023 inclusive, and prior to the effective date of this decree, will be suspended. If, within the framework of these processes, embargoes had been placed on funds and/or securities of any nature deposited in bank, non-bank or payment accounts, or the judicial intervention of cash had been carried out, the AFIP must arbitrate the pertinent means for the lifting of the precautionary measure, without transfer of the amounts effectively seized, which will remain at the disposal of the taxpayer.
  • Suspension, until the end of the productive cycle following the one in which the state of emergency and/or agricultural disaster endsfrom the income of advances corresponding to taxes on income and/or on personal assets and/or from the fund for cooperative education and promotion, whose maturities would have been set between February 1, 2023, inclusive, and the end date of the validity period of said state of emergency and/or disaster.

In addition, producers may deduct 100% of the profits derived from the forced sale of cattle, sheep, goats or pigs from the tax balance of the income tax.

The AFIP was empowered to implement and grant a plan of payment facilities of up to 48 monthly, equal and consecutive installments, applicable for the total or partial cancellation of all taxes and social security resources, including interest, fines and other sanctions, due until March 31, 2023 inclusive.

On this point, the debts originated in contributions and contributions destined to the National Social Works Regime and the quotas corresponding to the Occupational Risk Insurers (ART) are excluded.

According to the latest report from the National Drought Monitoring Table, published last March, the total area of ​​the country affected by droughts increased by more than one million hectares.

But the most outstanding thing is the increase of 19 million hectares in the severe category: this means a worsening of conditions in areas that were already affected, which reflects an increase in the impact on livestock systems, crops, and the population.

It also emerges from this report that more than 173 million hectares of the national territory are in drought conditions.
