In an escalating rent dispute, the tenant slipped out “Fuck you” – and received notice of termination. A court now cashed them in, with an interesting reason.
When is a landlord allowed to throw his tenant out of the apartment – and when not? This is a question that concerns the courts again and again. What many do not know: Insulting the landlord by his tenants can also be used to justify a termination. But it also depends on which words are used in which context.
The decision was made by the Köpenick district court in Berlin, according to the tenancy law and real estate working group in the German Lawyers’ Association, reports the DPA. After a long rental dispute, a tenant had used the expletive “Fuck you” against the manager in the hallway. The landlord had then given notice of termination and filed an eviction notice.
No offense
However, this was rejected by the report. The court is convinced that the verdict was not an insult, but a unique expression of displeasure. According to the court, this is a widespread use of the term in young people. Since the strong expression was used in a situation of distress and an already tense situation between the parties involved, it is not sufficient to evaluate it as an insult and therefore as a reason for termination.
The incident occurred as part of a previous rental dispute. The property manager had accused the tenant of leaving the apartment to others for use without permission. Therefore, there were several warnings and termination attempts. During the questioning, however, the court assessed the tenant’s statement as credible that the alleged sub-tenants were his steadfast girlfriend as well as a girlfriend on her part who occasionally came to visit.
Such visits are legally neither objectionable nor a matter for the landlord, the court clarified. Instead, it expressly reprimanded attempts by the property manager to confront the visitors and even copy their IDs. That is “emphatically objectionable.”
