Government seeks to collect debts from dealers

The State Assets Administration Agency (AABE) extended the validity of the payment facilities regimeso that the concessionaires of State assets regularize their debts in concept of royalties.

Through Resolution 132/2023 published in the Official Gazette; The state body extended until August 31 the validity of the scheme, which allows regularizing obligations owed as of July 31 of last year.

The AABE indicated in the recitals of the provision that the terms originally provided were “insufficient”, so it is “opportune” to grant an extension for the interested parties to formalize the entry into the scheme.

In this way, “the reception of a greater number of interested parties will be achieved, also redounding in a benefit to the patrimony of the National State.”

The latter is derived from the “positive impact on tax collection, as it is improved by the entry of additional funds derived from these obligations, originally unpaid.”

The regime provides for the cancellation of debts of the concessionaires in a payment without interest; or between 2 and 36 installments, with interest between 2.9% and 4% per month.

Said interests, in turn, can be reduced by 20% or 50%, in the case of real estate given in concession or permit for onerous use for single housing, sports, cultural or community activities; small agricultural producers, monotributistas, SMEs and cooperatives.

On the other hand, it stipulates the forgiveness of fines applied and the partial cancellation of punitive interest, 60% for obligations due in 2021 and up to July 31, 2022, 45% for the period 2018-2020, and 30% for 2017 and previous years.

Debts that are in the process of judicial execution are not contemplated in the regime.

In addition to the extension of the scheme, the AABE defined today that the concessionaires must pay, along with the monthly or total debt payment, an additional 2% of the total amount for “administrative and technical services” provided by the agency.
