AFIP gives the green light to the tax relief measures for MSMEs announced by Massa

The Federal Administration of Public Revenues (AFIP), through the General Resolution 5388/2023published in the Official bulletinestablished special conditions for the Micro, Small or Medium Companies (MiPyMEs) in relation to the determination and income of advances from Income Tax.

This general resolution establishesn new procedure for the determination and payment of advances of the lien for micro, small and medium enterprises (MiPyMEs) that begin their fiscal years at starting August 2023.

The new procedure consists in the application of a single percentage on the fiscal result of the previous fiscal year. The percentage to be applied will be 10% for MiPyMEs in the first tranche and 25% for MiPyMEs in the second tranche.

The general resolution will enter into force the day of its publication in the Official Gazette. However, the novelty will be available in the service “Tax Account Systems” from November 2023.

This general resolution It is a relief measure for MiPyMEssince it will allow them reduce your tax burden and improve its liquidity.

This resolution is applicable to Micro, Small and Medium Enterprises defined in the terms of the Article 2 of Law No. 24,467 and its amendmentsthat, at the beginning of the fiscal year for which the advances will be applied, have the “MSME Certificate” in force and are registered with the AFIP, under any of the following characterizations:

  • 272: microenterprises according to Law No. 25,300 and its amendments.
  • 274: Small Business according to Law No. 25,300 and its amendments.
  • 351: Medium Enterprise – Section 1 according to Law No. 25,300 and its amendments.
  • 352: Medium Enterprise – Section 2 according to Law No. 25,300 and its amendments.

For the rest of the taxpayers, the rates for the determination of the first advance will be 25%and for the remaining nine (9) advances, 8.33%.

SMEs: the keys to the tax relief announced by Massa

The Minister of Economy, Sergio Massaannounced a series of measures aimed at providing tax relief and financing for the micro, small and medium enterprises (MSMEs). These measures aim to support more than 515,000 companies in all the countrywhich represent approximately 4,000,000 jobs.

He Ministry of Economy pledged to support to more than 90% of MSMEs and 27% of the self-employed MSMEs. To achieve this, various tax measures that will benefit these companies.

One of the measures is to provide benefits in the payment of employer contributions. Microenterprises may user up to 30% of the amount paid as Tax on bank debits and credits as payment on account, covering up to 15% of employer contributions. This measure will benefit more than 240,000 microenterprises, which employ about 1 million people. The measure will take effect on August 1 and will run until December 31, 2024.

In addition, it was established an advance on earnings to reduce the impact of the first installment. This measure will benefit to more than 330,000 MSMEswhich employ about 3.5 million people. It will be available for the years starting from August 2023.

Another important measure is the exclusion of VAT perceptions and withholdingswhich will benefit 95,408 microenterpriseswhich represents a 38%dand societies MSMEs from the country.

As part of these support measures, an extension of the PyMEX Power Financing Program. The initial budget of this scheme was increased by 50%reaching a total amount of 19 billion pesos. With this expansion, 300 exporting SMEs from 19 provinces will be able to access financing in Non-Reimbursable Contributions (ANR) of up to 60 million pesos to promote investment projects that promote Argentine production internationally.

The objective of this program is to diversify the Argentine export matrixfor which we have worked in collaboration with the Undersecretariat for SMEs and the Center for Production Studies (CEP XXI). They have adapted a project evaluation methodology from Harvard University.
