Starting this month, micro-SMEs can compute it on account of employer contributions

The Federal Administration of Public Revenues (AFIP) regulated the payment on account of up to 15% of the employer contributions of micro-enterprises for the Argentine Integrated Pension System (SIPA), with 30% of the Tax on Bank Debits and Credits. The measure had been announced by the minister Sergio Massa before the primary elections.

As indicated by the General Resolution 5405 of the AFIP, the computation of the payment on account can only be made with respect to the amount received as Tax on Credits and Debits during the monthly accrued period of the contributions that are intended to be cancelled. That means that the tax on the check that the company pays in August can only be computed to the contributions destined to the retirement system of that month. If there is a remainder, it cannot be taken as payment on account in subsequent months.

“The Government has taken a step forward,” considered Sebastián Domínguez, from SDC Asesores tributarios, when considering the check tax as “distorting, which does not take into account the ability to pay, affects bank access, encourages cash payments and can contribute to evasion, among other effects.”

Payment on account of employer contributions to the Argentine Integrated Pension System can be computed with respect to remuneration accrued between August 1, 2023 and December 31, 2024. To do this, companies must have the SME certificate and be categorized in the lowest rung. Firms in this sector may also compute the payment of the Income Tax for the rest of the tax on bank debits and credits.

Microenterprises can compute the tax on debits and credits actually entered and not used as payment on account of employer contributions, as payment on account of income tax under the terms provided in art. 6 of Law 27,264 of the year 2016.

Domínguez pointed out that “although it should be eliminated, in practice it is very difficult to do so since it represents approximately 10% of the national tax collection and is destined for ANSES.”

The tax official estimated, however, that the impact that this measure could have on the company’s economy is low, since it is a discount of 15% compared to the 10% that constitutes the employer’s contribution to SIPA, which which implies an improvement in costs of only 1.6%.

Whitening

The president of the Budget and Finance Committee of the Chamber of Deputies, Carlos Heller, called for this Thursday to the Undersecretary of Public Revenue, Claudia Balestrini, the head of the AFIP, Carlos Castagneto, and the director of Customs, Guillermo Michel, to analyze a new tax laundering project presented by Sergio Massa in June.
