Increase in the Minimum Wage: who does it impact?

These adjustments will have repercussions on other aid, such as Potenciar Trabajo, Plan Accompany and the Unemployment Fund.

The National Employment Law (Law No. 24,013) establishes the concept of Minimum salary, vital and movil as “the lowest remuneration that the worker without family responsibilities must receive in cash, during his legal working day, so as to ensure adequate food, decent housing, education, clothing, health care, transportation and recreation, vacations and welfare” .

The Law establishes that “every worker over eighteen (18) years of age has the right to receive compensation not less than the minimum wage, vital and mobile, determined according to the legal provisions and the relevant organizations.”

The minimum, vital and mobile salary is also unattachableexcept in cases of food obligations.

The amount and method of delivery of the Minimum, Vital and Mobile Salary are established through annual conversations between representatives of the Government, unions and companies.

These delegates make up the National Council of Employment, Productivity and Salary, Vital and Mobile Minimum (CNEPSMVM), made up of a total of 48 members equally distributed in three categories with 16 representatives each.

the presidency of CNEPSMVM It is exercised by an individual selected by the Ministry of Labor, who also assumes the responsibility of calling council meetings in case it is considered necessary to update the Minimum, Vital and Mobile Wage. These meetings are essential to address the economic and labor situation in the country and ensure an adequate adaptation of the minimum wage to current circumstances.

Increase in the Minimum Wage: what is it for

He Minimum salary, vital and movil is used for example as parameter to determine salaries of teachers, the assets of retirees, the approvals of certain bank loans and even the Progresar scholarships for higher education studies.

It is also a standard on which many other programs and subsidies granted by different levels of the State to the most vulnerable populations depend. For example, the Work Strengthening Plan and the Unemployment Benefit.

And although each sector develops joint negotiations between employers and unions, none of the salary agreements reached in these discussions can set remuneration figures lower than the Minimum salary, vital and movil.

The Minimum, Vital and Mobile Wage must fulfill, according to the law, these three basic functions:

  • be the lowest remuneration that the worker without family responsibilities must receive in cash for his workday.
  • ensure the worker adequate food, decent housing, education, clothing, health care, transportation, recreation, vacations and social security coverage.
  • be adjusted periodically according to variations in the cost of living.

However, it is very difficult for the Minimum, Vital and Mobile Wage to meet all these conditions if it is even below the basic basket measured by the National Institute of Statistics and Censuses (INDEC).
