By granting them more favorable treatment than that established for people without disabilities, the decree seeks to guarantee that these people have the same employment opportunities as the rest of the population.
The Decree is an important step forward in promoting the labor inclusion of people with disabilities in vulnerable situations.
Through Decree 566/2023, the National Government modified the regulations of the Non-Contributory Pensions. The decree aims to promote the labor inclusion of people with disabilities, through the compatibility of the Non-Contributory Disability Pension with the registered work.
In the text, it is mentioned that the inactivity rate of people with disabilities is very high, due to the barriers they face in accessing work. To guarantee the right to work and social protection, the decree establishes that people with disabilities will be able to work without losing their pension, as long as they accredit and maintain the health and social vulnerability conditions that gave rise to their granting.
The decree also establishes that the National Disability Agency will dictate the criteria, procedures and documentation necessary for access and maintenance of benefits.
In summary, the Decree is a relevant measure launched by the Government to promote the labor inclusion of people with disabilities. By allowing people with disabilities to work without losing their pension, the decree gives them a greater opportunity to participate in the labor market and improve your quality of life.
The articles of the decree establish the following points:
- Article 1: Repeals section b) of paragraph 1 of Annex I of Decree 432/97. This section established that people with disabilities in a vulnerable situation must meet the same requirements as people without disabilities to access the benefits established by article 9 of Law 13,478.
- Article 2: Establishes that people with disabilities in vulnerable situations will have more favorable treatment in terms of labor inclusion. This means that they will have priority in accessing employment, as well as obtaining benefits and employment benefits.
- Article 3: The Ministry of Social Development, the Ministry of Labor, Employment and Social Security, the Ministry of Economy and the National Disability Agency are instructed to dictate the rules and acts necessary for the implementation of the provisions of article 2.
- Article 4: The National Disability Agency will dictate and determine the criteria, procedures and documentation necessary for access and maintenance of the benefits instituted by Article 9 of Law 13,478.
- Article 5: This measure will come into force on the day of its publication in the Official Gazette, that is, this Wednesday, November 1.
