The Russian Association for Electronic Communications (RAEC) appealed to the Bank of Russia and Rospatent with a request to intervene in the situation with the patent dispute between Samsung and Sqwin AG.
Earlier, the Moscow Arbitration Court ordered to stop the import and sale in Russia of 61 models of Samsung smartphones that support the manufacturer’s payment system. The decision was made on the claim of the Swiss company Sqwin AG, which believes that the vendor is illegally using its patent.
On December 6, the Ninth Arbitration Court of Appeal will consider another appeal of Samsung Electronics Rus Company and Samsung Electronics Co., Ltd against the decision of the Moscow Arbitration Court to restrict the work of the Samsung Pay service.
If these decisions are confirmed by the appellate instance, both of them are subject to execution regardless of whether or not a cassation appeal to the Intellectual Property Rights Court will be filed and within what time frame, lawyer Elena Feoktistova explained.
As a result, the launch of new payment services and services on the Russian market, including in cooperation with the Mir system, may be postponed indefinitely, which will limit the possibilities for its further technological development, the RAEC letter says.
According to the representative of RATEK Anton Guskov, the precedent is dangerous, first of all, because it may lead to the prohibition of access to the Russian market for cashless technologies not only for a particular brand, but also for technology in principle. Similar legal claims could be brought against other electronics manufacturers, he said. And this can lead to bans on the supply of other types of electronics to the market, and as a result to their serious shortage, said Anton Guskov.
The concerns of organizations are shared by the Association of Retail Companies (AKORT).
