President Javier Milei sent this Wednesday to the National Congress the “package of laws” within which he seeks to suspend retirement mobility.
The project that the National Government sent to Congress modifies twenty laws and among them proposes the suspension of the retirement mobility law approved during 2020empowering the Executive Branch to establish an automatic formula for adjusting benefits “taking into account the criteria of equity and economic sustainability.”

The formula that currently governs corresponds to a law approved at the end of 2020, 27,609. For its calculation it is considered the evolution of salaries (General Level Salary Index or RIPTE, whichever is higher) and the ANSES tax collectionin equal parts. The formula of Law 27,609 replaced the one established in 2017.


With the changes established in the omnibus law, the executive branch is empowered to establish a automatic formula adjustment of benefits “taking into account the criteria of equity and economic sustainability” but the initiative does not establish deadlines.
The Minister of Economy, Luis Caputo, had already anticipated that a new formula for retirement mobility will be sought because “with the current formula, retirees would earn between 25% and 40% less than inflation”.
