The Supreme Court of Justice of the Nation agreed to analyze the constitutionality of the DNU by Javier Mileibut warned that he will do so upon the return of the summer judicial fair, next February.
The decision of the highest court responds to the request from the Government of La Riojawhich requested this Friday that the “manifest unconstitutionality” of the DNU 70/2023 of economic deregulation, and to issue a precautionary measure that immediately suspends its application and assumes “original jurisdiction” to hear the matter.
In the “declarative action of certainty” it was requested to declare “the absolute and irremediable nullity of decree n°70/2023 because it is manifestly contrary to the Constitution” and that immediately “a precautionary measure be issued that provides for the total suspension of the effects.”
The Court is also asked to order the Executive Branch “not apply any of its provisions until the final resolution of this case.”
