The resolution aims to speed up the approval process for expansions of the electrical energy transportation and distribution system, especially those of small magnitude.
Through Resolution 65/2024 published this Wednesday in the Official Gazette by the National Electricity Regulatory Entity (ENRE) was modified the approval regime for expansions of the electrical energy transportation and distribution system.

Likewise, the resolution repeals ENRE Resolutions No. 33/2014 and No. 122/2014, which established that all expansions of the electric energy transportation and distribution systems, regardless of their magnitude, required obtaining a certificate of public convenience and necessity.
The new resolution establishes that expansions that fall within the category of “minor enlargement“will not require obtaining a certificate of public convenience and necessity, but may be authorized by the ENRE.
It defines “MINOR EXTENSION” to that which, according to its scope, size, execution times, incremental environmental impact and investment amounts involved, demand a simplified and agile in order to satisfy service needs.
The category of “minor enlargement“includes those extensions that meet the following requirements:
- They do not exceed a maximum investment amount specified in Annex I.
- Do not affect public space or non-impacted areas.
- They do not require the presentation of an environmental impact study.
Extensions that are not included in the category of “minor extension“will continue to require obtaining a certificate of public convenience and necessity.
The resolution also establishes that the ENRE may, at its discretion, determine the framing and treatment of the extensions presented, basing their decisions.
Requests for expansion or access to transportation capacity currently being processed at the ENRE must be redirected and continue to be processed in accordance with the provisions established in the new resolution.
