According to the newspaper report, with reference to the Ministry of Finance, entrepreneurs who request corona aid must “confirm certain conditions in the application mask when applying for aid measures, including compliance with the requirements of the guidelines. The conditions now also include an obligation to comply with the Covid- 19 Measures Act and the ordinances issued on its basis. ” This is also associated with “a repayment of the aid money in the event of an administrative violation in accordance with Section 8 (4) of the Covid-19 Measures Act”. And “As before, the reasons for repayment are (…) incomplete or incorrect information or the hindrance of control measures.” The respective guidelines are the legal basis for this.

In the event of violations, there is a risk of repayment

In the event of violations, the catering and retail businesses are threatened with repayment of the aid payments made, announced Chancellor Karl Nehammer (ÖVP) and Health Minister Wolfgang Mückstein (Greens) these days. The “tongue-in-cheek sausage” with mask compulsory or 2G controls could no longer exist.

At most companies, the customer area – with certain exceptions for health reasons, for pregnant women and children – can only be entered in compliance with the 2G rule. This does not apply to the food trade or workshops, veterinary practices or the agricultural trade. Pre-ordered goods and meals can also be picked up without 2G proof. According to “Presse”, this also applies to buying Christmas trees outdoors. Of course, there is currently a general mask requirement in all closed rooms – except when sitting in the catering trade, when it is open again.

This applies once until December 21st, if the current regulation expires. Apart from the lockdown, an extension is expected. This means that it is then still a question of how the 2G rule – in addition to the executive and health authorities – should also be controlled by companies.

Chairwoman of the retail division: “Will have to offer solutions”

Margarete Gumprecht, chairwoman of the trade division of the Vienna Chamber of Commerce, emphasized the readiness for controls, according to “Presse”. “We will have to continue to live with the pandemic. If we want to keep business open in the future, we will have to offer solutions,” she is convinced. They want to work out this by January. “We will also call in experts,” says Gumprecht. Technical access systems are conceivable, “whereby the question then also arises: will there be subsidies for this?”

In the Christmas business, they are not yet equipped for incoming checks, but are ready for random checks, some of which are already taking place – with individual retailers already going beyond random checks and asking customers for 2G proof upon arrival. The current corona rules only provide for the rejection of customers without 2G proof in places where the companies also have an obligation to inspect, i.e. currently in the catering trade and at the hairdresser. Of course, the other companies can exercise their domiciliary rights – business initiation is voluntary on both sides.
