Everything you need to know about the deregulation of social and prepaid works

The important thing is to know how this is going to work: until now, people who worked in a dependent relationship, in order to be able to transfer their contributions to a prepaid plan, had to do so through a social work with which said prepaid plan had agreement.

At the end of December 2023 he entered the DNU of the president of the Nation, Javier Milei which, among many issues, established that they were going to deregulate prepaid and social worksa novelty that was recently regulated through three decrees.

The important thing is to know how this is going to work: Until now, people who worked in a dependency relationship, in order to be able to derive their contributions to a prepaid plan, had to do so through a social work with which said prepaid plan had an agreement.. For example: to derive the contributions to the prepaid “X” we had to triangulate them through a social work that had an agreement with that prepaid X.

But following these decrees, This was modified and people who work in a dependency relationship, if they want, will be able to derive their contributions directly to the prepaid pension that they have, or that they want to have, without an intermediary social work.. This option will probably be used by many people who today have social services that only broker contributions without providing any health services. Each one will have to evaluate if the social work they have provides any health service and if, then, it is better to maintain it or directly refer the contributions to a prepaid one.

Something very important to know is that this decree applies to workers in a dependency relationship. Monotributistas, retirees and pensioners will continue with the regime they currently have, in which they can only choose a health agent who is registered to accept that type of beneficiaries. This modification also does not apply to provincial social works (for example IOMA, OBSBA) or special ones (OSPJN, IOSFA, etc.) since they are not governed by the national social works law.

The keys to knowing how this new regulation will work:

The Superintendency of Health Services created the National Registry of Insurance Agents (RNAS), so that prepaid companies that want to act as a social work and receive beneficiaries directly with contributions and contributions, can register in said registry. So, those who want to directly transfer contributions to the prepaid plan will have to enter this registry to check if the prepaid plan they want is registered.

In the case of being registered and completing the procedure, it is important to clarify that the person will NOT have to pay anything extra and in return what they will receive is the coverage of the Mandatory Medical Program (that is, the same thing that the social works): the minimum floor of obligations, which every health agent must compulsorily cover. If the person wants a plan that exceeds that PMO, then he will have to pay the difference between his contributions and the cost of the chosen plan.
