Debtors will have the right to correct the data in the bankruptcy petition out of court. Such a proposal is being worked out within the framework of a bill to improve this procedure, Deputy Minister of Economic Development Ilya Torosov told Izvestia. Within one month after the inclusion of information on the initiation of insolvency proceedings out of court in the Unified Federal Register of Bankruptcy Information (EFRSB), a citizen will be able to clarify his application to the MFC once, he said.
“The debtor will not be limited in the ability to correct any information reflected in the initial application, including the list of creditors with the amounts owed,” Ilya Torosov said.
Creditors will have the right to demand through the court that the rules on exemption from obligations be not applied to the debtor, the deputy minister said. This addition will allow them to protect their rights in the event of possible abuse by citizens, added Ilya Torosov.
The Ministry of Economic Development and Trade is preparing amendments to the law on insolvency to improve the procedure for out-of-court bankruptcy of citizens. Earlier it was reported that as part of these changes, the required debt threshold will be increased from 500 thousand to 1 million rubles, at which the borrower can start a bankruptcy mechanism without a trial.
