What happens if the flight is brought forward? The European Court of Justice has passed a ruling – and has guaranteed passengers a flat-rate compensation.
In the future, passengers will have the prospect of compensation if their flight is brought forward by more than an hour. The airlines have to pay a flat-rate compensation of between EUR 250 and EUR 600 for each route if they do not inform them in good time about the postponement.
That emerges from a judgment of the European Court of Justice published on Tuesday. Specifically, it says: “A flight is to be regarded as” canceled “if the operating airline brings it forward by more than an hour.”
This deprives passengers of the opportunity to freely dispose of their time, according to the Luxembourg judges. The new departure time could force passengers to make great efforts to get to the airport on time. In the event of such a “significant” advance, the airline must always pay the full amount of the compensation (cases C-146/20, C-188/20, C-196/20, C-270/20, C-263/20).
According to the EU Air Passenger Rights Regulation, providers do not have to pay compensation for cancellations if they give notice in good time. This is the case, among other things, if travelers are informed at least two weeks before departure.
