Through General Resolution 999/2024 of the National Securities Commission (CNV), published this Thursday in the Official bulletinthe provisions related to the figure of the Virtual Asset Service Provider (PSAV) were modified.

The official text introduces changes to the existing regulations and establishes the centralization of information on PSAVs in a Registry administered by the National Securities Commission (CNV).

The Resolution incorporates the requirements for registration in the Registry of Virtual Asset Service Providers. To streamline the registration and cancellation procedures in this registry, it was decided to delegate these powers to the Registration and Control Management of the CNV.

The text also mentions that the delegation of powers is carried out in accordance with what is permitted by the National Law of Administrative Procedures and its regulations, without undermining the formalities necessary to protect the recipients of the administrative acts.

Likewise, it grants administrative consent for certain statutory modifications, such as the change of corporate name, the modification of the duration of the company, the modification of the closing date of the fiscal year and the change of domicile of the company.

The rule states that the delegation of these powers aims to speed up the adoption of decisions in the aforementioned procedures, due to operational reasons.

Key points

  • The Resolution comes into force on the day of its publication in the Official Gazette.
  • The delegation of powers does not imply the creation of a new body nor does it prevent the CNV Board of Directors from issuing acts on the same matters.
  • Delegation is a temporary technique for distributing powers.
