It has now been established that the freight and insurance that are part of the purchase condition agreed upon with the seller can be canceled completely, starting from the first date on which the importer has access to pay for the goods included in the same commercial operation.

Last Tuesday, the Central Bank (“BCRA”) issued the Communication “A” 7998through which the deadline that must be met to be able to access the Exchange Market to effect freight payment and insurance of certain categories.

The Communication “A” 7917 of 12/13/23established a scheme for access to the Exchange Market for payments of imports of goods, applying different deadlines, depending on the tariff position of the merchandise.

In this context, It was established that the freight and insurance that are part of the purchase condition agreed with the seller can be canceled completely, from the first date on which the importer has access to pay for the goods included in the same commercial operation.

Now, Communication 7998 establishes that freight and insurance for import operations of merchandise related to the automotive industry (included in Point 10.10.1.3 of the Regulations on “Exterior and Exchange”) may be canceled after 30 days, counted from the customs entry registration of the goods. Previously, they could be paid once 180 days had passed since customs entry was registered.

Summary of changes

  • General term: Freight and insurance that are part of the purchase condition agreed upon with the seller may be paid in full from the first date on which the importer has access to the imported goods.
  • Exception: For freight and insurance related to the payment of goods identified in point 10.10.1.3. of the regulations, the period to access the exchange market to cancel its value will be 30 (thirty) calendar days from the registration of customs entry of the goods.
  • Application: The new deadlines will also apply to operations under the concept “S30. Freight services for goods import operations” within the framework of point 13.2.3. of the “Exterior and Changes” regulations.
