The new regime of origin debuts: what changes will impact foreign trade?

The Mercosur regional bloc agreed on a new regime that will govern regional trade between its members starting Thursday. These are some of the main changes.

He New Mercosur Origin Regime (ROM) It comes into effect from this Thursday Thursday, July 18. This regulation It was approved at the bloc’s Summit of Presidents on July 4 last year and includes a series of changes that modify the operation of regional trade and are key for importers and exporters.

The aim of this new regime is the facilitating trade and deepening the integration process. The new rules in force were approved by Decision CMC 05/2023, which establishes the new ROM, and by CMC 06/2023. The new ROM has seven chapters, 56 articles and ten appendices throughout which provisions relating to the criteria of:

  • qualification of origin
  • requirements for conferring origin
  • certification mechanisms
  • procedure for verification by the customs authority.

The main novelties of the Mercosur regime

Regarding the version of the regime created by CMC Decision 01/2009, which was in force until todayThe new ROM introduces changes such as the unification of the origin requirements in a single list, which covers the entire tariff universe. In this way, it seeks to facilitate the identification of the standard that a product must meet to be considered as originating in MERCOSUR.

It also modifies the value calculation formula and moves from measuring the percentage of regional value contentthe measurement of the maximum amount of non-originating materials allowed in the production of a good. In relation to this issue, the requirement for originating materials is relaxed by 5%: until now, a 60% regional content value in originating materials had to be met, but now this percentage has increased to 55%, without prejudice to the differential treatment granted to less developed countries mentioned in the standard.

It has updated the Certificate of Origin model with new information fields and the elimination of others, and its validity period was extended to twelve months. However, for twelve months – from the entry into force of the new regulation – both models of certificates of origin will coexist.

The establishment was made Return of guarantees required by the customs authoritywithin a period of one hundred and fifty days from the start of the verification of origin with respect to an import, even if it has not yet been concluded.

On the other hand, All deadlines for verification and origin control procedures were reviewed to make the ROM more efficient and agile than the current one, and the possibility of expanding the process of verifying the origin of the good and the materials used in its production was incorporated. It was also established that the criterion of origin of a product is maintained when entering a Free Trade Zone in accordance with CMC Decision 33/2015.

It was also included, an article that excludes automotive sector products from the ROM since trade in this sector is governed by current bilateral agreements.

These are the essential elements that They will come into effect from July 18 for trade in Mercosur and exporters and importers must take them into account. in its interregional operations.
