After launching the possibility of paying tips Through digital media, the Government reported that Special accounts set up for this purpose will be exempt from paying the tax on debits and credits, known as the check tax.
Through decree 737/2024, it was established that the “special collection accounts referred to in article 6 of Decree No. 731/24, used exclusively in the administration and operation of transfers and payments that constitute tips under the terms of the aforementioned Decree” will be covered by this exemption.
The new system, which It does not replace the possibility of leaving tips in cashif it requires businesses and establishments in the gastronomic, hotel and related sectors to enable means for consumers to withdraw money from a digital wallet.
The decree clarifies that tips are not part of the worker’s remuneration, so they cannot be used as a basis for adjusting salaries nor will they be subject to withholdings.
From now on, these businesses will have to offer the option of giving tips through electronic means, thus adapting to the growing use of digital money in the country.
In addition, it is stipulated that businesses must transfer tips received to employees within 24 hours, without applying discounts.
The Central Bank and the Ministry of Economy will be responsible for supervising compliance and issuing the necessary complementary regulations for the correct implementation of this measure, which will enter into force 90 days after its publication in the Official Gazette.
How tipping will work with virtual wallet
The tip money may go directly to the account of the employee involved or be credited to a separate business account to be transferred to the workers within 24 hours, digitally or physically, without discounts or deductions.
Following this decision, payment collection service companies will have to provide businesses with the option of receiving payment with a tip so that consumers can add an amount to the bill. Consumers will be able to scan any QR code and pay with the debit card, credit card or virtual wallet of their choice.
The measure will not generate any tax obligation for merchants nor will it be considered part of the employment relationship. Businesses, debit and credit cards and electronic payment methods will not be able to make any type of withholding or collection of tips.
