Unanimity in Deputies to advance a law against tax evasion

In a brief meeting, members of the Lower House decided to update the amounts to consider tax evasion punishable.

Within the framework of the security and justice agenda which has an intense parliamentary work agenda, the Chamber of Deputies ruled unanimously (21 signatures from all blocks) to update the sums of tax evasion which are punishable by imprisonment.

Until now, a constitutionally governed nominally established amount which has been maintained since the last reform of the law, in 2011. That is why the deputies decided modify the wording of the law so that penalties are subject to fixed unitswhich are updated monthly in each district. As a parameter, the sum of a fixed unit in the province of Buenos Aires is $1,336 for November 2024.

The project agreed upon by the Criminal Legislation Commission is authored by the man from Córdoba Oscar Agost Carreño (Federal Meeting)who explained that “Inflation is distorting how investigations and criminal proceedings are carried out” in matters of tax evasion, in addition to explaining that the new legislation offers administrative and material tools in the face of a demand from “prosecutors in the interior of the country who did not have sufficient resources to carry out these trials and had to choose which ones to carry out and which ones not to carry out. “.

The initiative must still be voted on in a session of the Chamber of Deputies but, if approved, it establishes prison sentences of 2 to 6 years for tax evasion when it is ten fixed units, while it worsens 3 and a half years up to 9 years of sentence for evasions greater than 100 fixed units or for misappropriation of documentation and identities.

Next Wednesday, November 20, the possibility of submitting commission opinions to the sessions this year ends, so the Criminal Legislation Commission displaced another topic that I had planned to debate this day: the reform of the law of self defense and use of strength in fulfillment of power.

As explained by the head of the commission, the representative Laura Rodríguez Machado (PRO)the intention is to unify the writing of that project together with another, authored by Gabriela Brouwer de Koning (UCR)called “Blas Law” that aggravates the penalties of security personnel who plant illegitimate evidence to sabotage crime scenes.
